In my opinion, and not legal advice ! : Say your piece and offer your evidence. I was booked for speeding with a Speed Gun, and in court they said a speed that was 1mph more than the speed shown to me on the device at the time. It irritated me for years, maybe 5-6 years of arguing the injustice of it in my head - over 1 mph ! If you genuinely think you are in the right then get it off your chest in court otherwise it will do your head in !
The bench will look at it this way Steve ,you've got through a red but at a level crossing is worse than a traffic light because of the amount of danger the level crossing entails,the amount of passengers on trains as opposed to another car that is the way the bench will think and the likely hood is you will get points the other way round at a traffic light you would have had a chance,take the points or it could cost you immense if you persue,I can see your argument tho
Nice to see everyone's getting along nicely on a Friday evening.... The start of sequence is "if working correctly" Amber light solid for three seconds, with an audible warning "for pedestrians" this then transfers to intermittent flashing reds, the tolerance is milliseconds between flashes. The Highway Code says if you have reached the white line as the Orange light illuminates then keep going. Presuming your travelling at your claimed 40mph as you hit the white line your traveling 50 odd feet per second. More than enough time to clear the crossing legally. If it illuminated 2 seconds before that? 1 your now within the safe stopping distance at your speed, 2 on paper you still have room to make the crossing before a red illuminates, so long as you haven't reduced your speed? 3 anything before that, they're telling you you ain't paying attention to the road or reducing your speed knowing you're approaching a hazard that could change at a seconds notice "a bit like approaching an uncontrolled beast if you wish" It would be a difficult one to judge without the cctv, if BTP intend to prosecute they'll produce this as evidence, if they ain't got it then it's your word against there's hearsay and all the political jazz. I wouldn't even begin with the old the car behind was too close for me to stop. They'll produce their Highway Code and hit you over the head with it, And then show you where it says if a car behind is travelling too close then the car in front should reduce speed to reduce the risk of collision. Not legal advice, just what I get to know out in the field. Lights can cock up, and if you feel you have a valid case then run with it, good luck.
If people have issues with each other why do it on an open forum, why not do it through personal messages. This should be a good place to be.
I completely agree Nick, i simply gave my opinion (may have been a little harsh but I'm being honest) only to be called a "cock" by some little squirt. However I'm more than happy to go one better than personal messages, I'm happy to meet up with whomever has an issue with me

I joined this forum because I thought it would be a good place to be with everybody having things in common, helping each other out where we can and having a bit of craic. Anyway, I'm the new kid around here, so I'll bow out of it and let you guys get on with it.
I don't have an issue with that either Matt. You can have my address via PM if you like, and I'm no little squirt either! However, it wasn't my place to interfere, it just polls my piss when someone asks for advice only to be shot down by some keyboard warrior hence why I jumped in. If you knew it was a harsh response then why type it. There was no need for it (or for my interference) so I'll leave it at that. Nice advice @Garyb .
If BTP are prosecuting they will have photos and/or video of you going over on red, they'll show it to the court, and the court will find you guilty. May not be fair but the reality is the court will believe BTP over you, and the added bonus is you will get a bigger fine etc for having the audacity to defend yourself.
Haven't been on here for ages- Everyone's entitled to a view and they were asked. Personally I wouldn't waste my time taking video's, writing letters etc- More important things in life to worry about.
