its just a noise restriction flap in the exhaust pipe. just pull the cables off it so it stays open all the time.
when I did mine I opened mine up, gutted it then put in new perforated pipe and lagging.gave it a nice loud deep note. looked a bit like this...
Haven't used the D5000 but I would have thought the D40 would have had more features
