Another sneaky way of extracting more money. This came up recently for my partner and premium increased by about £80.

I'm sure it's £100 fine now & the 3 points will stay on your licence for 4 yrs & only allow you wiggle room of another 9 points in that time before a ban under normal circs. If it was me I'd do the course which is a bit cheaper & keep a clean licence.

The fine won't be £60 either. In the summer last year, the government put up the fines from £60 to £100 for all offences which carried 3 points.
There are no awareness courses that I know of that cater for level crossing red light contravention.

I have seen many people go to court to argue their case and defend themselves, and the court rarely find the case in their favour. But, completely up to you chap.

As for the car behind you, they should be driving with a certain level of anticipation, like you should too, that the barriers 'could' come down immediately, and therefore drive appropriately to the circumstances, and then if they were to hit you from behind, then the law would see that as the driver driving too close.

You have to ask yourself, 'Can I stop in the distance I can see to be clear', so if that car was to hit you, then their insurance company would pay out, and thus no points for you.

I personally would have been more inclined to stop for the barrier, but hindsight is a wonderful thing.

The points will stay on your licence for 3 years to declare, but on your driving record for 4 years, which allows the police to check what endorsements you've had in the past.

Also, to argue at court and potentially loose, means that a Magistrate can give more points than the initial offence covered. Depends on what they feel is necessary/appropriate

Dorset police site shows that DAS may be considered for red light contravention at level crossing so would think other forces Inc one where Steve hit it do the same

Now now boys lets all get on!
Happened to me, nothing I could do, delayed payment and it cost me extra, I felt angry.
I think you should pay fine and fight afterwards if you feel wronged, good luck

Most insurance companies want you to declare points for the last 5 years

Yep, you're absolutely right. I meant they'd stay on your licence for 3 years. Miss type.

If you're telling the truth and I think you are, I think you've got a 'bit' of a case. I think they will def' do you but if you come across as genuine and not some wanker trying it on they may be a bit more lenient.

You'll prob' get your three points but could get a ban also so unless you're not bothered about a ban I'd turn up and 'humbly' say your piece.
